Azerbaijani Military Prosecutor’s Office has initiated a criminal case on the use of chemical weapon against the civilian population by Armenia, the Military Prosecutor’s Office told APA on May 13.
Azerbaijan National Agency for Mine Action (ANAMA) discovered an unexploded phosphorus artillery shell in Terter’s Eskipara village. On May 11, ANAMA specialists exploded the shell in compliance with relevant security rules.
Employees of the special investigative unit of the Azerbaijani Military Prosecutor’s Office inspected the area hit by the chemical artillery shell.
Preliminary investigation made it clear that the unexploded shell found in the Eskipara village is a type of munitions – a 122-mm D-4 (smoke shell) artillery shell with 3.6kg P-4 (chemical code of white phosphorous) chemical composition inside.
By using such types of shells, Armenia grossly violates the Geneva Conventions for the protection of war victims (1949), the Protocol Additional to these conventions (1977), as well as the Convention on Certain Conventional Weapons (1980) and the UN Convention on the Prohibition of the production and use of chemical weapons (1992).
Armenian armed forces, by ignoring the norms of international humanitarian law, continue to use such types of weapons not only during the shelling of Azerbaijani army positions, but also the settlements and civilians.
On this fact, the Military Prosecutor’s Office of Azerbaijan opened a criminal case under articles 29,120.2.7 (attempt to murder of two or more people), 29,120.2.12 (attempt to murder on ethnic, racial and religious grounds) and 116.0.16 (the use during armed conflicts of weapons, means and methods of warfare prohibited by interstate treaties).
The Military Prosecutor’s Office of Azerbaijan continues the preliminary investigation on the case.
