The number of preliminary investigations conducted by prosecuting authorities is being reduced.
Azerbaijani Parliament told APA that an amendment is proposed to the Code of Criminal Procedure in this regard.
According to the amendment proposed to article 215.3 of the Code, articles 167 (illegal production, import, sale or distribution of religious books, objects, and other informational materials) and articles 168 (encroaching upon citizens’ rights under the guise of performing religious rites) are being removed from the list of cases preliminary investigations of which are conducted by prosecuting authorities. So, the prosecuting authorities won’t investigate such cases.
Azerbaijani President’s decision guided by article 215.5 of the Code will determine which bodies will conduct preliminary investigations on the articles stripped from power of the prosecuting authorities.
According to the valid article 215.3 of the Code of Criminal Procedure, prosecuting authorities can conduct investigation only into the cases envisaged in articles 100-113, 120-125, 126.3, 135-138, 145, 146, 149, 154-164, 165.2, 165-2, 165-3, 166.2, 167-168, 169-1, 179, 189-1, 190, 191, 193-1, 195, 195-1, 202-203-1, 208, 210-212, 222, 223, 262, 268, 286-288, 290-302, 304, 307-315, 316-2.1, 317, 317-1.2, 318-1, 321, 323 of the Criminal Code.
The draft amendments have been recommended to the plenary session of Azerbaijani Parliament and will be put up for the discussion on March 14.
