Juridical investigation on demolition of mosque completes in Baku

The juridical investigation into the demolition of the Fatimeyi Zahra mosque has ended in Baku. The Surakhani District Executive Power appealed to the local Economic Court 2 to demolish the Fatimeyi Zahra mosque, located in the Yeni Gunashli settlement 33 of the Surakhani District. The court completed its juridical investigation and will announce the final resolution on Aug.31, Rovshan Shiraliyev, lawyer, representative of the Fatimeyi Zahra religious community, told Trend News on Aug. 28.

The Surakhani District Executive Power states that the area where the mosque was constructed had been given to its possession at order of the Baku City Administration. The mosque was illegally built and the Surakhani District Executive Power appealed to the regional court to demolish the mosque and ancillary buildings in the territory. The Surakhani District Executive Power of Baku suspended the construction of the Fatimeyi Zahra mosque, located in the Yeni Gunashli settlement 33 of the Surakhani District. Members of the religious community “Fatimeyi Zahra” are not allowed entering the mosque.

In 1996 the head of the Baku City Executive Power ordered to allocate the area in the village of Yeni Gunashli to construct the Fatimeyi Zahra mosque. Necessary documents for the construction were prepared by the city authorities. However, in late 2002, referring to non-use of the area for a long time the Baku city authorities passed an order to cancel the previous order and to transfer the land plot to the possession of the Surakhani District Executive Power for constructing sports and entertainment complex. Following this order, representatives of the community met with the deputy head of Baku City Executive Power, Rauf Panahov.

Panahov said that the order was given by mistake and there is no reason for concern on the issue of the construction. In 2009, the Surakhani District Executive Power appealed to the court, referring to its rights over this area. The Baku City Executive Power was involved to the process as a third party. The court also took the defendant’s counterclaim into execution. The religious community filed the counterclaim, which demands eliminating orders of the Baku City Executive Power, dated 2002, and suspending unlawful interference of the Surakhani District Executive Power.

Over the last year the mosque of our Prophet Muhammad and the mosque at the Oil Rocks were demolished in Baku as illegal facilities.
