Azerbaijan to change rules on renouncing and obtaining citizenship

If Azerbaijani citizen who obtained foreign citizenship does not inform the relevant executive authority about it within a month, she will bear responsibility in accordance with the Criminal Code

 

Azerbaijan will change rules on renouncing and obtaining citizenship.

 

Azerbaijani Parliament told APA that annexes and amendments are proposed to the law of the Azerbaijan Republic on citizenship.

 

According to new 4th item annexed to the article #5 of the law, affiliation of the person to the citizenship of the Azerbaijan Republic is determined and confirmed by the relevant executive authority.

 

First item of the article #6 of the law is abolished – certificate of birth is removed from the list of documents confirming citizenship of the Azerbaijan Republic.

 

The 2nd item to be annexed to the article #10 of law means: “If Azerbaijani citizen who obtained foreign citizenship does not inform the relevant executive authority about it within a month, s/he will bear responsibility in accordance with the Criminal Code”.

 

The name and context of the article #12 of the law will be changed: Article 12 – “The citizenship of children born on the territory of Azerbaijan of stateless person and foreigners

 

The child born on the territory of Azerbaijan and whose parents are foreigners is not a citizen of the Azerbaijan Republic. The child born on the territory of Azerbaijan and whose one of parents is foreigner and another stateless person is not a citizen of the Azerbaijan Republic. A child born on the territory of Azerbaijan of stateless persons is a citizen of Azerbaijan Republic”.

 

Current article is “Acquisition of the citizenship of Azerbaijan Republic by children of

stateless persons”.

 

A child born on the territory of Azerbaijan of stateless person is a citizen of Azerbaijan Republic.

 

At the same time, the text of the article #18 of the law (forfeiting the citizenship of the Azerbaijan Republic) will be changed: “Taking into account the provisions of the Convention on the Reduction of Statelessness” dated to 30th August, 1961, reasons for forfeiting the citizenship of the Azerbaijan Republic can be following if:

 

1) Citizen of Azerbaijan Republic voluntarily obtains citizenship of other country;

2) Citizen of Azerbaijan Republic voluntarily serves at state bodies and municipalities, or armed forces and/or another armed units of the foreign country;

3) Citizen of Azerbaijan Republic behaves damaging state security;

4) While acquiring the citizenship of the Azerbaijan Republic, a person has deliberately falsified the data necessary to acquire the citizenship, or submitted a falsified document”.

 

Current article is “If, while acquiring the citizenship of the Azerbaijan Republic, a person has deliberately falsified the data necessary to acquire the citizenship, or submitted a falsified document, he/she shall forfeit the citizenship of the Azerbaijan Republic”.

 

The project has been recommended to the plenary meeting of the Parliament and will be discussed on May 30.
